History

Peta Whyte, managing director of CWS Lawyers, was admitted to practice in 1998 after completing her articles at law firm McCusker and Harmer. In 2001 Peta, together with McCusker and Harmer partner, David Clark, took over the conveyancing practice of McCusker and Harmer and renamed it Clark Whyte. In 2003 both Michael Salmon and Mark Diamond joined the practice. Michael was also admitted to practice in 1979 and was a partner in his own firm Majteles and Salmon and a partner at Phillip Fox before joining Clark Whyte as a partner. Mark Diamond joined the firm at the same time as a senior associate.

In 2007 Clark Whyte was split into CWS Lawyers and Mortgage Settlements Australia - WA. Mortgage Settlements Australia - WA was subsequently sold to the national law company MSA National Pty Ltd. Both Michael and David are directors of MSA National Pty Ltd. CWS Lawyers was then purchased by Peta Whyte and Patrick Whyte in 2019.

DIRECTOR

Peta Whyte

Peta Whyte is the managing director of CWS Lawyers, formerly Clark Whyte and McCusker & Harmer. Peta has practiced law for over 25 years.

Peta provides legal advice to clients particularly in the areas of complex bank transaction, lending, finance, commercial leasing, property, sale agreements, development agreements, shareholders agreements and estate planning. Peta also takes a “hands on” role in overseeing the conveyancing practice area of the firm. CWS Lawyers act for a number of Perth’s leading developers of land and off the plan apartments as well as undertaking commercial, business, farming and residential sale settlements. 

Peta is a member of the Law Society Property Committee and has an extensive knowledge of property matters in Western Australia. 

Peta is also a member of the Joint Form of General Conditions Committee for the Law Society and is the Law Society representative in the Office of State Revenue Liaison Committee.

Patrick Whyte

Patrick Whyte is a director of CWS Lawyers.

With his expertise as a Certified Practising Accountant (CPA), Patrick is responsible for managing the financial aspects of the firm. With his comprehensive understanding of finance, accounting, and business practices, Patrick brings valuable insights to the team.

Within CWS Lawyers, Patrick's primary focus lies in effectively managing the financial operations of the firm. He leverages his financial acumen to ensure the smooth functioning of the firm's financial processes, optimising efficiency and facilitating the provision of exceptional legal services to clients.

 
 

 
 

SENIOR ASSOCIATE

Mark Diamond

Mark was admitted to legal practice in December 1997 and works exclusively in litigation. Mark currently oversees mortgage default and workers' compensation practices of the firm. Mark has over 13 years experience in both of these areas and acts for workers' compensation insurers and financial institutions. Mark also has experience in other personal injury claims such as motor vehicle accidents.

David Clark

David has been involved in banking and property law since his admission to The Supreme Court of Western Australia in 1979. David was a long standing member of the Property Law Committee of the Law Society of Western Australia and held the role of Convenor of this committee, he was also the Chairman of the Conveyancing Industry Liaison Committee and a member of Landgate's Customer Service Council. David is also a member of the Law Council of Australia's Electronic Conveyancing Committee.
